RE: The tariff classification of poly screen doors from China.

Dear Mr. Ward:

In your letter dated April 23, 2009, on behalf of Snavely International, you requested a tariff classification ruling.

The sample provided with your letter, identified as Instant Screen™, is marketed as a poly screen door for solar and bug protection. The screening material is composed of a woven fiberglass scrim that is coated with polyvinyl chloride (PVC) plastic. You have submitted a breakdown showing that the PVC and fiberglass each account for 50 percent of the value. The screen door can be installed with either a tension rod or hook and loop fastener strips, both of which are included. The screen door measures 81 inches in height and 37.5 inches in width.

The applicable subheading for the poly screen doors will be 3925.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for builders’ ware of plastics, not elsewhere specified or included…doors, windows and their frames and thresholds for doors…doors and door frames. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
